## On the ballot

- **Max Hsia** — Small Business Owner · Republican
- **Alex Lee** — State Assemblymember · Democratic · Incumbent

Assemblymember Alex Lee took 65.4% of the June 2 vote and Republican Max Hsia took 25.0%. The district covers Milpitas, Fremont and part of San Jose.

The winner holds one of 80 Assembly seats for a two-year term, inside a 12-year lifetime cap on service in Sacramento. An Assemblymember authors bills, sits on the policy committees that decide which bills advance, and argues for the district's share of the annual state budget. Committee assignment is where most of the leverage sits, and it is handed out by the majority's leadership.

The incumbent has one of the smaller business-funded shares on this ballot and one of the larger committee-funded ones, which is a different funding pattern from most of his neighbours rather than a smaller one. The challenger, per the Milpitas Beat, is running explicitly to break the district's Democratic hold. Weigh a legislative record against an argument about one-party representation.

## Alex Lee

Alex Lee, a Democrat, is the sitting Assemblymember for this district. He grew up in Milpitas and San Jose "as the son of immigrants," and before his 2020 election he worked as a legislative policy advisor in both the Assembly and the Senate (Milpitas Beat). When he won the seat that year at age 24, he became one of the youngest members and the first openly bisexual member of the California Legislature (Milpitas Beat).

He has said his campaign is "grounded in our community" and "not beholden to special interests," and that residents "shouldn't be priced out of the neighborhoods we grew up in" (Milpitas Beat). In January 2026 he introduced the No Tax Breaks for ICE Contractors Act, saying "California does not subsidize corporations that profit off of ICE's terror campaign" (Milpitas Beat); he later co-authored Assembly Bill 1633 with Assemblymember Ash Kalra, which would impose a 25 percent tax on private companies operating immigration detention centers (San José Spotlight). AB 1633 passed the Legislature and, as of late September, awaited the governor's signature.

He promises to keep pushing on the housing crisis, including inclusionary zoning, ending single-family-only zoning, stronger tenant protections and social housing (Milpitas Beat). His platform also lists transit expansion, stable public school funding and refusing "special interest money."

**Strengths:** A bill he co-authored to tax companies that run immigration detention centers passed the Legislature this year and awaits the governor's signature.

**Trade-offs:** His recent statements center on immigration enforcement, with less detail available on other 2026 priorities beyond his standing housing platform.

**Keep in mind:** In 2020, before he took office, he was cited for violating a protest curfew. He said the citation caused him anxiety before his court date, not that it changed his politics.

## Max Hsia

Max Hsia, who lives in San José's Berryessa neighborhood, owned and operated a food and retail business for about a decade before selling it and becoming semi-retired. He joined the Santa Clara County Republican Party in 2025 and began volunteering on local ballot measures before running for this seat (Milpitas Beat). "I'm no stranger to blue collar work and rolling up my sleeves," he has said of his background (Milpitas Beat).

He argues California needs Republican representation to check one-party rule in Sacramento: "That means a lot of the policies affecting us day to day with cost of living, housing, schools – all being passed without balance," he said (Milpitas Beat). He has never held elected office, so his campaign statements, not a governing record, are what voters can judge.

His platform lists cost of living and housing, including encouraging lower-cost construction with fewer regulations; crime prevention measures such as license plate readers and citizen's-arrest authority for certified security guards; and education reform with merit-based pay tied to student test results (Milpitas Beat).

**Strengths:** He is a first-time candidate running in a district Republicans have not won in years, with a specific platform on housing, crime and schools.

**Trade-offs:** He has no record in elected office, so his platform and business background are what voters have to judge rather than a governing record.

**Keep in mind:** His coverage focuses on his campaign strategy and platform more than personal biography beyond his business career and recent party involvement.

Figures are CA Form 460 filings through June 30, 2026 by committees controlled by each candidate, and can include transfers from a candidate's earlier committees. Semi-annual reports covering January–June 2026 were due July 31, 2026, so some totals lag a period behind. Per the California Secretary of State's Cal-Access raw data export, retrieved 2026-09-21.

Max Hsia has no itemized contributions dated after the June 2, 2026 primary reported to Cal-Access yet.

Total is itemized (Schedule A) contributions and self-funding loans dated after the June 2, 2026 primary, through June 29, 2026 — small-dollar unitemized (under $100) contributions aren't independently dated in Cal-Access's raw export, so they aren't reflected here and this may undercount true small-donor activity since the primary. This also doesn't include money reported only on 24-hour late-contribution reports (Form 497) that haven't yet appeared in a periodic Form 460 filing.
